That will be a question for the Federal Judiciary to decide. I think that, if this does go through, you will see a Supreme Court decision on the matter. There are likely to be several challenges to the legislation.

Marijuana prohibition is a violation of the 10th amendment, but many conservatives are for that... seems hypocritical to me. Also, I don't think people should be making a big deal about the Democrats using the self executing rule. The Republicans used it over 35 times in the years 2005-2006, or so said a Republican representative from Washington State.
