Well, here's the deal. Companies are like tiny little dictatorships, owners own them by virtue of having the money to buy or start them, and as long as all the owners in a geographic area or field are generally incompetent to the same degree (although in different ways) then he's not going to go out of business for being an a$$. There is a lot of room in a company for waste and the fact that someone owns a company that hasn't gone under yet doesn't mean he is smarter or better than you.

But here is the catch, most business owners do think they are better than you. We have an entire culture where if you luck into something, like having family money to start a business or your parents sent you to a private school, or you are naturally thin, then you must be better than other people. The people who think they are superior, but certainly can't prove it with intelligence or hard work, have to look for other differences.

They used to belittle women's skills in the work place, denigrate the intelligence and work ethic of black people, and spread all sorts of negative stereo types based on nationality. Now that this is clearly illegal and less socially acceptable even in private conversations, these people, who still exist, have had to find other groups to denigrate to make themselves feel superior by comparison. They have mostly latched on to perceived behaviors, such as being gay, being a smoker, or being overweight.

Specifically about being overweight, the huge multi-decade campaign in every type of media has not changed significantly anyone's behavior and made the nation as a whole healthier. It has however made millions of people depressed and thousands suicidal. Why do people keep reinforcing these ideas if they are not helping the people they are aimed at?

Because they are not supposed to help fat people, they are there to reinforce the idea that naturally average to skinny people are morally superior to the minority, even though they are not actually struggling to accomplish anything. A million people a year die of malaria at far younger ages than those who die of heart disease, yet for the most part our society doesn't bother trying to fight that health problem because it doesn't give the average idiot someone to look down on in their local community. To answer your question about harassment, in 99.9% of communities obesity is not a protected class because most people in general still believe obesity is about being lazy and not caused by an underlying medical condition.

The exceptions, such as San Francisco, are fairly famous and I think an internet search would fairly quickly tell you if you lived in such an area. As for it being general harassment, if he was stupid enough to fire you in front of people or in writing for that specific reason it still would probably not be actionable because most states have laws stating that you can be fired for any or no reason as long as it is not due to being in a protected class (race, religion, age, sex, martial status, disability). If a person was female and that person's boss showed a lot of interest in and made comments about that woman's weight then it is likely that could be considered sexual harassment, because the implication is that his interest is for non-work related reasons.

Here's the important thing, just because you can't do something to directly punish this fool, don't forget it. It is time to look for a new employer. Remember your labor is worth more than you are paid for, part goes to pay for over head and his and his wife's salaries.

Don't give money to someone who treats you poorly. While continuing to work, and doing the best job you can, start applying for a new job. On applications check the box that says, "Don't contact my current employer", that is why it is there.

Some companies won't consider an application with this box checked, but if they ask explain the reason, they might still consider you. And try to not let anyone where you currently work know you are looking, and why you are looking. He is sure to fire you then because "it is bad for moral" which basically means he doesn't want the implied criticism.

Don't give in to fools because then fools win. Keep employed as long as possible, but look for a new employer. The attitude of your immediate supervisor makes all the difference about whether you can be happy and productive at work, or even if you want to advance with a particular company.

Lighten up (no pun intended). In a miniscule company, everyone thinks of each other as family and they treat each other very casually. He's probably just trying to help you, like some parents try to "help" their kids by saying things the kid knows but doesn't want to hear.

Don't do anything. But if it bothers you so much, next time simply tell him that you don't want to discuss your weight. If he's so comfortable bringing up personal things with you, be comfortable enough with him to tell him how it makes you feel.
