Jobless brother leeching off of me?

You can break your lease, but you will be liable for rent until the place relets. Florida has laws that favor the landlord, so the amount you owe could be quite high. Additionally, the landlord has no obligation to market the place so it is relet in a timely manner.

As far as paying rent to the HOA, do NOTHING of the sort until a court document tells you to do so. If you are getting conflicting stories, open a separate savings account and deposit the rent money in there each month, on time. This will be your escrow account.
