Technically, as soon as you bid, you have a legally enforceable contract to buy the item if your bid wins the auction. They CAN sue, but they probably won't. More likely you will have your eBay account marked for a none payment.

This will allow sellers to ban you from bidding on their items. It is also possible you could be banned from eBay entirely.

The best thing is to contact the seller and try to sort things out. Apologize profusely and say that you don't have the money to pay for the phone, and in any case never received it. If you are under 18 years of age, tell her that too.
